PacWest Gives Back: Privacy Notice

Who we are

pacwestgiveaways.com ("PacWest Gives Back") is operated by Pacific West Injury Law and presented by Pacific West Injury Law, 8180 Rafael Rivera Way, #200, Las Vegas, NV 89113 ("we," "us"). Contact: privacy@pacwestgiveaways.com.

What we collect and who we share it with

Information you give us: first and last name; email address; your statement that you are 18 or older (you give it when you join); residential ZIP code (and the city and state derived from it); optional phone number (we never send text messages); your entry choices, answers, votes and task completions; photos or screenshots you upload for a task; your consents and preferences.

If you join the community: your membership date and preferences (you can enter future giveaways in one tap; each giveaway still asks you to accept its rules).

If you share your personal link: the share you made and anonymous visit counts to that link (to award points only when someone else visits); we do not identify the people who click.

Winners only: date of birth or birth year (to confirm you can win; after the giveaway's retention period we keep only the year; our staff may also note your birth year if they sign you up in person), street address, proof of identity and residency (a photo ID only for larger prizes), signed declarations and releases, the payout method you choose and, for Zelle or a mailed check, the Zelle email/phone or mailing address you give us (encrypted), and, only if tax law requires it, the taxpayer identification number on IRS Form W-9. We never collect bank account, card numbers or passwords: if you choose a bank deposit, debit card, Venmo, PayPal or Cash App through our payout partner, you enter those details only on the partner's secure page.

Collected automatically: device and browser type, IP address and the approximate location derived from it (city or region level, we do not collect precise GPS location), pages viewed, the QR code, link or invitation that brought you here, and push-notification subscription tokens if you turn on alerts. When you give or change a consent we keep a record of it, including the IP address, as evidence of your choice. To stop duplicate or reused photos we compute a digital fingerprint of each uploaded image (not facial recognition).

What we never collect: health, injury, accident, medical, fitness, biometric, reproductive or disability information. We do not use facial recognition or any other biometric processing on photos.

Categories of third parties we share with:

• The Sponsor, Pacific West Injury Law, which presents the giveaways. Entering does not create an attorney-client relationship, and we do not use your entry to contact you about legal services.
• Service providers acting on our behalf: website hosting and databases, content delivery and bot protection, email delivery, push-notification delivery (your browser's push service, such as Apple, Google or Mozilla), file storage, an AI writing assistant our staff use to draft giveaway descriptions (it never receives entrant information), and, for winners, prize delivery.
• Payout partners (winners only): our payout partner (Tremendous) receives your name, email address and prize amount so you can choose and receive your payment; if you choose PayPal or Venmo through PayPal, PayPal receives your name, handle and amount. They handle your bank, card or wallet details under their own privacy policies.
• Ticket platforms (ticket winners only): Ticketmaster or AXS receives the email address you give us for the mobile ticket transfer.
• Advertising platforms (such as Meta, which runs Facebook and Instagram, Google and TikTok), members only:we share your email address, phone number, name, city, state, ZIP code, birth year and member ID number, usually scrambled before we send them, and sometimes your number of entries, points or wins. To measure ads we also send the ad click ID (a code the ad platform adds to the link you tapped), Meta's browser ID if your browser has one (a code saved in your browser), and the date and time of each giveaway entry or win, with the giveaway name and prize value. We do this to show you PacWest Gives Back giveaway ads, measure those ads (for example, whether an ad click led to an entry or a win), or avoid showing ads to people who already joined. We never share your giveaway answers, photos or payout details, and we never use this for legal-services ads. This is part of being a member and only includes people who agreed to it when they joined. If you do not want it, email us at privacy@pacwestgiveaways.com to close your membership and delete your information. We do not include residents of states whose laws give them a right to opt out of targeted ads.
• Government authorities when required by law (for example, the IRS for tax reporting, or a state that requires a winners list).
• A successor organization in a merger, acquisition or similar transaction.

We do not sell covered information.

How we use it

To run giveaways and contests (eligibility, entry limits, drawings, winner verification, prize delivery and tax reporting); to send transactional messages (sign-in links, entry confirmations, results and prize updates); if you opt in, to send giveaway and event emails, push alerts and reminders (reminders are per giveaway and you can stop them with one tap); to show members PacWest Gives Back giveaway ads on advertising platforms and measure them (see above); to prevent fraud and bots; to measure, in aggregate, which campaigns, events and sources work; and to comply with law.

Third-party tracking

No third-party ad pixels or trackers run on this site. But for members who agreed to it when they joined, ad platforms (such as Meta, Google and TikTok) get the ad click ID or browser ID from the ad you tapped, together with when you joined or won. This lets them connect what you do here with ads you saw on other websites and apps. See "Advertising platforms" above. We honor Global Privacy Control signals as a request to opt out of any sale or sharing. Our site does not otherwise respond to browser "Do Not Track" signals.

Review, correct or delete your information

Sign in to My Giveaways to view and manage your email and push preferences, or send a request to view, correct or delete your information to privacy@pacwestgiveaways.com. We verify requests by sending a link to the email address on file.

Nevada residents, opt out of sale (NRS 603A.345)

Although we do not sell covered information, you may submit a verified request directing us not to sell any covered information we have collected or will collect about you, at privacy@pacwestgiveaways.com. We will respond within 60 days; we may extend once by up to 30 days and will tell you if we do.

Your choices

Unsubscribe from marketing email with one click in any marketing email. Turn off push alerts in My Giveaways or in your device settings. You will still receive transactional messages about entries or prizes you have.

Sharing with advertising platforms is part of being a member, so there is no separate switch for it. If you do not want it, email us at privacy@pacwestgiveaways.com to close your membership and delete your information.

Children

This site is for adults 18 and older. We do not knowingly collect personal information from children under 13. If we learn we have collected information from a child under 13, we delete it.

Security

We use reasonable security measures, including encryption in transit, additional encryption for sensitive winner information (like payout details), and access limited to authorized staff with multi-factor sign-in. We never ask you to email identity documents. If a breach affecting your personal information occurs, we will notify you as required by law.

Retention

We keep entrant information for up to 24 months after a campaign ends, delete uploaded photos and screenshots 90 days after a campaign ends unless you agreed to a longer use, delete winners' ID images and full date of birth 90 days after the prize is delivered (unless a dispute or tax matter requires longer), delete payout handles 13 months after payment, delete share-link visit records 90 days after a campaign ends, and keep winner, tax and required advertising records for at least 4 years. When we delete information we make it unreadable.

Changes to this notice

We will post any updated notice here with a new effective date. For material changes we will also show a notice on the site and email subscribers before the change takes effect.
